data protection declaration from time to time to reflect changes in legislation or case law. The updated
version will then apply to those customers who have registered for our services after the publication of
the new data protection declaration.
2. Scope of application of this data protection
declaration
2.1 The GDPR is concerned with the protection of personal data. This includes data
that can be assigned to your person (e.g. your name, telephone number or email address). It does not
include information that cannot be directly linked to your actual identity (such as the content you view
on a website).
3. When and why do we collect information about you?
3.1 When
you simply visit our website, we store the following information by default: – your IP address – the
website from which you are visiting us (referrer) – the Sympany websites you visit – the date and duration
of your visit – browser type – browser settings – operating system. We analyse this data for statistical
purposes.
3.2 We use cookies to determine the preferences of visitors to our website and to
make it easier to use, for example, by avoiding the repeated entry of data.
3.3 In addition, we
only store your personal data if you send it to us voluntarily, e.g. when you register for the service,
complete online forms or send us a message via the contact page. In these cases, we ask you for certain
personal data that is necessary for the fulfilment of the service. We mark any mandatory information
accordingly; all other information is provided voluntarily.
3.4 The information collected about
you when you register with the provider and when you use our services helps us to provide you with our
services. However, certain information, details or content that you optionally provide may contain
sensitive data, such as your ethnic origin, nationality or religion. Our customers do this on their own
responsibility and initiative – posting this data is not mandatory. Even if the data can only be seen by
registered members, always be aware that you are in a public space and treat your privacy responsibly.
3.5
If you have given us your express consent, we will send you promotional offers from selected business
partners. If you do not wish to receive offers from us or our partners, you can indicate this when you

3.6 Our website
uses functions of the web analysis service Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4,
Ireland. For this purpose, cookies are used that enable an analysis of the use of the website by its
users. The information generated thereby is transferred to the provider's server and stored there. You
can prevent this by setting up your browser so that no cookies are stored. We have concluded a
corresponding contract with the provider for commissioned data processing.
3.7 You have the
option of subscribing to our newsletter via our website. To do this, we need your email address and your
consent to receive the newsletter. In order to provide you with targeted information, we also collect and
process information that you provide voluntarily. As soon as you have registered for the newsletter, we
will send you a confirmation email with a link to confirm your registration. The data you provide when
registering for the newsletter is stored on the servers of our newsletter processing provider Mailchimp
(Rocket Science Group, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308), with whom we have a data
processing agreement in accordance with the GDPR. You can unsubscribe from the newsletter at any time by
clicking on the unsubscribe link in any of our newsletters. We will then immediately delete your data in
connection with the newsletter dispatch.
3.8 We would like to point out that for the purpose of
simplifying the purchasing process and for subsequent contract processing, the web shop operator stores
the IP data of the connection owner in the context of cookies, as well as the name, address and payment
data of the buyer. In addition, the following data is also stored by us for the purpose of contract
processing: delivery address, payment date. The data provided by you is required for the fulfilment of the
contract or for the implementation of pre-contractual measures. Without this data, we cannot conclude the
contract with you. Data will not be transferred to third parties, with the exception of the transfer of
credit card data/payment data to the processing bank/payment service provider for the purpose of debiting
the purchase price, to the transport company/shipping company commissioned by us to deliver the goods, and
to our tax advisor to fulfil our tax obligations. In the event of a contract being concluded, all data
from the contractual relationship will be stored until the expiry of the tax retention period (7 years).
The data name, address, purchased goods and date of purchase are also stored until the expiry of the
product liability (10 years). The data processing is carried out on the basis of the statutory provisions
of § 96 (3) TKG and Art. 6 (1) (a) (consent) and/or (b) (necessary for the performance of a contract) of
the GDPR.
4. No disclosure to third parties
4.1 We will not disclose your
personal data to third parties without your prior consent, unless there is a legal obligation to do so,
e.g. due to a public prosecutor's or court order.
5. Cookies
5.1 Cookies
are small text files that we store on your device using your browser. They do not cause any damage. We
distinguish between the following cookies: A) Session cookie; the session cookie stores the current data
of the visit to our website. It supports the functionalities of the website and is automatically deleted
after your visit. B) Persistent cookie; this cookie records the surfing behaviour of our customers on our
pages. With this data, we can, for example, localise errors and improve support. This cookie is
automatically deleted after a certain period of time.
5.2 The help function in the menu bar of
most web browsers explains how to set your browser so that it does not accept any new cookies, how you can
have your browser notify you when you receive a new cookie, or how to reject all cookies. However, the
correct functioning of our website is only guaranteed if you allow cookies for this site, which is why we
recommend that you leave the cookie function turned on.
6. Security and archiving
6.1
In individual cases in which you send us personal data (for example when transmitting your payment data),
we offer you the option of transmitting the information in encrypted form. This encryption protects the
confidentiality of the data exchange between you and our web server and helps to prevent misuse of the
data, for example by eavesdropping. We use SSL (Secure Socket Layer) as the encryption technology. This is
a recognised and widely used technology. If the transmission of the data is not marked as encrypted by
SSL, it will be carried out according to the usual security standards of unencrypted transmission.
6.2
With regard to our databases, all technical precautions have been taken to archive your data in a secure
environment. Access to your information is restricted to a few selected employees and is only possible in
certain cases. In principle, the password you have chosen is not accessible to anyone. Personal
information provided during your registration that is not part of your profile is not available to third
parties and will not be transferred, sold or exchanged with third parties. The cases mentioned in this
data protection declaration are an exception, of course, subject to your prior notification and
declaration of consent or in the absence of an objection on your part.
6.3 Due to limited
storage space, messages exchanged and saved by you via the website will be stored for one year and then
automatically deleted, even if you remain registered. After your paid registration has expired, your data
will be deleted. It may be necessary to archive data, for example, if we have been informed that someone
has not followed the rules of the game.
7. Consent
7.1 On some of our pages,
we ask you to consent to the use of data for advertising purposes. Each customer can, when registering or
at any later time, order, for example, the sending of our newsletter and/or the sending of advertising
offers from partners by email and/or to their mobile phone and can unsubscribe from these mailings at any
time and free of charge. However, it is not possible to unsubscribe from some information messages, e.g.
regarding contracts and services for customers. These are part of our service.
7.2 By clicking
the checkbox during registration, you give your consent as follows: I agree that – other Internet users
can view my company data, including the images I have uploaded, over the Internet. – the provider uses
spam filters to protect me from unwanted e-mails, for example, automatic measures are taken to prevent
e-mails with 0900 numbers or certain inappropriate keywords from being sent to me; – other Internet users
can write messages to me (I know that the provider does not disclose my e-mail address and that the
messages are sent to me via a message form. – my company data is statistically evaluated. – the data
provided during my registration and the data voluntarily provided by me as part of my profile are used to
present me with personalised advertising or special offers or services via the service; I can unsubscribe
from such personalised advertising at any time by email. – the provider passes on my inventory, usage or
content data to investigating authorities, law enforcement or data protection supervisory authorities, if
and to the extent that this is permitted under criminal or data protection laws, for example if this is
necessary for security or criminal prosecution; – the provider collects, processes and uses the usage
data, among other things with the help of cookies, in order to provide customised offers and to facilitate
the use of the website.
8. Your rights
8.1 In principle, you have the right to
information, correction, deletion, restriction, data portability, revocation and objection. If you believe
that the processing of your data violates data protection law or your data protection rights have
otherwise been violated in any way, you can complain to the supervisory authority. In Austria, this is the
data protection authority.
8.2 Naturally, we will tell you, upon request, whether we have
stored any personal data about you and, if so, what data. In this case, we require sufficient proof that
you are entitled to receive the data (authentication). This prevents third parties from gaining access to
your data. We constantly strive to ensure that your data is correct and up to date. However, should
incorrect information have been stored, please let us know so that we can correct it immediately.
